The Court of Appeal in Abuja has overturned the Federal High Court’s decision that mandated the Peoples Democratic Party (PDP) to allow the participation of 381 ad-hoc delegates in its February 22, 2024, primary election.
The primary election had already resulted in the selection of Asue Ighodalo as the party’s candidate for the upcoming Edo State governorship election on September 21, 2024.
In its ruling on Monday, a three-member panel of the appellate court set aside the previous judgment delivered by Justice Inyang Edem Ekwo on July 4. The appellate court determined that the Federal High Court lacked the jurisdiction to hear the case brought forward by the aggrieved delegates.
Furthermore, the court ruled that the plaintiffs did not possess the legal standing necessary to file the lawsuit.

The Court of Appeal emphasized that the Federal High Court should not interfere in the PDP’s internal decision-making process regarding its candidate selection for the Edo State governorship election.
